Terms of Service

These Terms of Service (“Terms”) govern your enrollment in any program offered by NextArc Learning LLC (“NextArc,” “we,” “us,” or “our”) and your use of nextarclearning.com and the NextArc AI study tool. By submitting an enrollment form, joining a waitlist, or using the site, you agree to these Terms on behalf of yourself and the student you are enrolling.
Program enrollment
By enrolling in a NextArc program, you confirm that you are the parent or legal guardian of the student listed on the enrollment form, that you are at least 18 years old, and that your student meets the stated grade eligibility (grades 6 through 11). Enrollment is finalized once you receive a confirmation email from NextArc and your deposit is received.
Payment
The program fee is $130 per student for the full two-week session. Payment is due upon confirmation of enrollment. Payments are processed by Stripe; NextArc does not store payment-card information.
Refund policy
Full refunds are available up to 7 days before the program start date. Within 7 days of the start date, refunds are not available, but your spot can be transferred to another session. If NextArc cancels a session for any reason, all enrolled students receive a full refund automatically.
Sessions and attendance
Sessions are held virtually via Zoom. Students who miss a session can request a make-up summary, but live attendance is expected. NextArc is not responsible for technical issues on the student’s end, including device, connectivity, or third-party platform outages.
Conduct
Students are expected to engage respectfully with instructors and fellow students. NextArc reserves the right to remove a student from the program without refund for conduct that disrupts sessions, violates these Terms, or violates applicable law.
Intellectual property
All program materials, resources, instructional content, and the NextArc AI question banks provided by NextArc are proprietary to NextArc or its licensors. You may not share, reproduce, distribute, or create derivative works from these materials outside the program without written permission from NextArc. You retain ownership of any work product your student creates during the program.
NextArc AI use
NextArc AI is provided to enrolled families and to the general public on an “as is” basis. Progress data (XP, mastery, badges) is stored locally on your device and is not transmitted to NextArc. You agree not to use NextArc AI in any way that would violate applicable law, infringe third-party rights, or attempt to scrape, mirror, or republish the underlying question banks.
Privacy
Your submission of personal information through the site is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimer of warranties
Except as expressly stated, the NextArc website, NextArc AI, and NextArc programs are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. NextArc does not warrant that the site or any program will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the maximum extent permitted by applicable law, NextArc’s aggregate liability arising out of or relating to these Terms or your enrollment is limited to the amount you paid to NextArc for the program at issue. In no event will NextArc be liable for indirect, incidental, special, consequential, or punitive damages.
Governing law and venue
These Terms and any dispute arising out of or related to your enrollment with NextArc are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws provisions. You and NextArc agree that any legal action will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and each party consents to the personal jurisdiction and venue of those courts.
Consumer protection
Nothing in these Terms limits any rights you have under the North Carolina Unfair and Deceptive Trade Practices Act (N.C.G.S. § 75-1.1) or other applicable North Carolina consumer protection laws, or any non-waivable rights you have under the laws of your state of residence. If any provision of these Terms is held unenforceable under applicable law, the remaining provisions will remain in full force and effect.
Changes
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Continued use of the site or enrollment in a program after a change indicates your acceptance of the updated Terms.
